California Meal Break Laws

Under California law, employers must provide employees with at least a 30-minute meal break if they work more than five hours in a day (or six hours for the motion picture industry). Employees must be allowed to take the meal break off-site or on-site at their discretion, and they must be relieved of all work-related duties during this period.

California Rest Break Laws

In addition to meal breaks, California employers must provide non-exempt employees with a 10-minute break for every four hours they work. Similar to meal breaks, this rest period can be taken off-site or on-premises and should involve no work-mandated tasks.

What Happens if These Laws Aren’t Followed?

If an employer fails to comply with California meal and rest break laws, the employee may be entitled to compensation for the missed meal or rest break via lawsuit. If a violation is found, the employee can receive one hour of pay for each work day they were not provided a meal or rest break. Keep in mind that overtime work can sometimes influence the penalty and compensation you are owed as well.
